Access to this web site (the “Web Site”) is subject to and in accordance with the following terms and conditions. Please read these terms and conditions carefully before using this site.

These terms and conditions are between Peak District Yarns (“we/us/our”) and you, the user of this Web Site (“you”).

On accessing the Web Site on this occasion and on each subsequent occasion you will be deemed to have accepted all of the terms and conditions that apply to its use and to the facilities, services and information provided by it. We reserve the right to alter these terms and conditions at any time and it is your obligation to check if changes have been made. Your use of the Web Site after changes are posted on-line will constitute acceptance of the new terms and conditions.

1. Using the Website

Making a Purchase:

Making a purchase from the Peak District Yarns website could not be easier. Just browse our shop categories, and add any items that you wish to buy into your Basket. After you have finished your selection, click on ‘Checkout’ and you will be asked for a few details that we need to be able to complete the order.  Note that we accept Paypal payments only.

When confirmation of order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when we send you an email confirming despatch of your order. We have included this term to protect us in the unlikely circumstance that a mistake has been made on the website, and we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.

Due to the limitations of computer screens, image colours may vary from actual yarn colours, with certain colours being particularly difficult to reproduce on screen. Please use the images on our website only as a guide, and please do not use them to colour match yarn.

When you make a purchase, we will add you to our email marketing list.  You can unsubscribe from this at any time.  We will not share your details with any other organisations, and will only send occasional communications to you.  These communications will include news about new products and special offers.

Pricing and availability:

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. All goods are sold subject to availability and prices of products may change from time to time. If we discover an error in the price of any goods ordered by you, we will inform you of this as soon as possible and give you the option of confirming your order at the correct price or cancelling it. Peak District Yarns reserves the right to change the price of any item on the Website where that item has been priced incorrectly.

If we are unable to contact you regarding an item that was priced incorrectly we will treat the order as cancelled. If this happens and you have already paid for the goods, you will receive a full refund via Paypal. Neither of us shall have any further liability to the other. This shall not affect your statutory rights. If you reconfirm the order, no contract will exist with us until you have received the email confirming your goods have been despatched, as per above.

Delivery costs will be charged in addition to the cost of the product; such additional charges are clearly displayed where applicable and included in the total cost at checkout.

Returns Policy:

You have the right to cancel an order within 14 days of receipt of the goods.  Should you wish to cancel your purchase within 14 days, please contact us via email on carrie@peakdistrictyarns.co.uk. Providing that unwanted goods are received back to us in their original condition – unused, unwound from the skein, with all labelling still attached – and in a resalable condition within 14 days of receipt, we will refund the price of the goods (less any discount which was applied to the item when you purchased it).  PayPal payments will be refunded to your PayPal account.  Refunds will usually be made within 7 working days after we have received your returned goods.

We cannot accept liability for goods returned to us which are lost or damaged during transit. You are advised to wrap the product carefully to avoid damage. You are also advised to return goods by recorded delivery, or by courier. Proof of postage will not be accepted as proof of delivery. With your return parcel, please remember to advise us of your name and address, and include a copy of your purchase receipt/invoice. The cost of returning goods will be borne by yourself unless the goods are faulty. We will only exchange goods should they be faulty or, in our opinion, misrepresented online.  Mismatches in colour are not a valid reason for misrepresentation.

At Peak District Yarns, our goal is to delight you with our customer service. This is why, In addition to above legal rights, if you are not completely satisfied with your purchase, we will gladly accept returns up to 60 days from the date of purchase provided you return the item unused, with all labelling still attached, and in a resalable condition.  The cost of returning goods will be borne by yourself unless the goods are faulty. Please email us if you do wish to return an item.

Faulty items

Please email us if you have a problem with an item that is damaged or defective. We will discuss with you arrangements for rectifying the problem. If we agree that an item is damaged or defective, we will refund the delivery charges incurred in returning the item to us.  We check all items returned to us and if we cannot find a fault, we reserve the right to re-charge you for the item(s) and to recover any costs incurred in recovering it from you.  All refunds will be made via Paypal.

In all cases where you are not happy with your purchase, please notify us within 14 days of receipt of your item.

Shipping And Handling:

All orders to be delivered within the UK will be sent via Royal Mail postal service. All other orders will be sent by surface mail. Postage and packing charges apply to all items purchased on the website.

Delivery rates:

These will be calculated for you at checkout. For UK customers there is a flat charge of £3.80 per parcel. Smaller items which can be sent as “Large Letters” are charged at either £1.80 or £2.80 depending on the weight. UK customers sometimes benefit from offers of free postage, which will feature on the website from time to time.  Peak District Yarns does not sell internationally, sorry.

Peak District Yarns reserve the right to notify you if postage to your chosen destination is significantly higher than the postage rate indicated due to the destination or the bulk and/or weight of the item being shipped. If this is the case we will email you with information about the amended rate and will only proceed with the order when you confirm that the amended amount is acceptable.

Delivery:

We aim to post out all orders placed via the website within 4 working days.  However, we are unfortunately not in control of what happens once Royal Mail have them. In our past experience they are generally very good.  Please allow 14 days after your notification that your order has been despatched before contacting us about any missing orders – it can sometimes take this long for parcels, thought lost, to turn up.  Surface mail to international destinations will take longer – and the estimated delivery times will be subject to any delays resulting from postal delays or force majeure (events outside our control, for example due to inclement weather or strikes) for which we will not be responsible.

Commissions:

Carrie is happy to take on yarn dyeing commissions if you have a specific colourway in mind.  A precise delivery time for commissions cannot be guaranteed. It will depend on the complexity of the commission, what else she has on at the time, and even the weather as it affects drying conditions.  Carrie will discuss the options with you when you contact her to request a commission, and after you have decided on which option will confirm a price.

Whilst Carrie will do her best to reproduce the colours you are requesting, there are so many variables that she can’t guarantee that the colourway will be identical to that which you have in mind when you place a commission.  These variables include the colours on her camera, the quality of your monitor, and the dyeing conditions.  Also, there may be slight colour variations across skeins if you commission more than one skein.  Once you place your order via a commission you are committing to pay for the yarn produced for you.

This Web Site, and any content contained on it, is for information purposes only. We do not warrant that any information contained in this web site is accurate, up to date or complete.

We do not accept any liability arising from any inaccuracy or omission in any of the information on this Web Site or any liability in respect of information on this Web Site supplied by you, any other user or any other person.

Intellectual Property:

You acknowledge that all trade marks, names and logos on the Web Site are the proprietary marks of us. To the extent that there are marks identifying third parties, these are owned or licences by those third parties and nothing in these terms and conditions in any way confers on you any licence or right under any trade marks, name or logos.

All rights, including copyright, in the content of this Web Site and in the photographs, diagrams or any other illustrations of our products displayed on it are owned or controlled by us.

You may not, without the prior written consent of us copy, reproduce, modify, republish, adapt, alter or in any way commercially exploit any of the content of this Web Site.

Privacy:

You acknowledge and agree to be bound by the terms our privacy statement.

Liability:

We take all steps that we consider in our sole discretion necessary in order to provide you with a reliable service. We exclude, however, to the fullest extent permitted by law, any liability for the security or availability of the services on the Web Site or for any disruption of our web site however caused.

We provide the Web Site on an “as is” basis and make no warranties or representations of any kind as to the Web Site or its content. We make no representations or warranties about the accuracy, completeness or suitability for any purpose of the content published on the Web Site. Any liability, however it occurs, for any such inaccuracies or errors is expressly excluded to the fullest extent permitted by law.

Indemnity:

You agree to indemnify and hold us and any of our officers, employees and agents harmless from and against all and any expenses, losses, liabilities, damages, costs or expenses incurred or suffered and any claims or legal proceedings which are brought or threatened, in each case arising from your use of, or conduct on, the Web Site and/or a breach of these terms and conditions.

We may terminate the provision of the Web Site or restrict your access to it without any prior notice to you.
